Spring is the time for wild birds to nest. All wild birds, including pigeons, crows, magpies and swans and their eggs are protected by The Wildlife and Countryside Act 1981 (WCA)
It is an offence to intentionally:
1) Kill, injure or take any wild bird
2) Take, damage or destroy a nest whilst in use or being built
3) Take or destroy and egg of any wild bird
Commonly reported offences include vandalism type incidents of people killing ducks and swans in local parks. These offences are often treated seriously by the courts, because of the distress caused to other members of the public. Courts have given custodial sentences for killing mute swans.
Remember, that mute swans are unusual because they are considered the property of the Queen and the police can potentially consider offences of theft and criminal damage, which don’t apply to other wild birds.
