    boiler safety

    Why do I as a Landlord have to have the boiler of my tenant, checked by a gas safety plumber every year. When a private house holder does not?

    As an example I rent out a flat, in a building of 6 flats, the others are all privately owned, I asked at the AGM did they have their boiler serviced and gas safety checked. Only one said they had it serviced and didn't know if this included a gas safety check,

    The answer is really quite simple.

    YOU are responsible for the safety of your tenants.

    As a landlord you are responsible under the law for the safety of the tenants . Your are required for the gas safety and hold a current safety certificate , and the same goes for the electrical installation. Where there is multiple occupation , fire doors should be in place and operational .

    Because without laws to protect tenants, landlords won't spend the money on essential safety checks, and tenants will die.

    Take a modern civilised country without such laws it would seem ;

    Private owners are responsible for their own Health and Safety. As a Landlord, you provide the necessary appliances and you are responsible for these. The rent that your tenants are paying to you, is paid on agreement that you will ensure the safety of those tenants while leasing your property. Not just boilers, but all appliances, domestic services, any furniture you provide and the whole infrastructure of the premises.

    It is YOUR boiler, but other people's lives depend on it operating correctly. If the private owners fail to maintain their boilers then it is likely to be only them at risk. When it comes to cars, everyone is required to get them tested through the MOT (once over 3 years old) again because other people are at risk if maintenace is neglected.

    Simply because you are a landlord, hiring or renting out anything, from tools, cars or premises, you as the owner are responsible for the safety and/or fitness for purpose of the item being rented or hired.
