He can do it because he sets his wife up in a foreign bolt hole and puts everything in her name.

You've partly answered your question - to quote LJ Ward in the Court of Appeal - "this is a court of law, not of morals".

The difficulty is that the only offence which could have led to imprisonment is fraudulent trading which is notoriously difficult to prove. He is still under investigation for wrongful trading (a civil offence) and he has paid £363m into the pension scheme following a negotiation with the pensions regulator.

Not defending him, but if I were a BHS pensioner, I would rather have the money than the pleasure of seeing him in prison.

Yep - although again the best he can be done for is probably wrongful trading - which is the view of the parliamentary committee. He'll be disqualified from being a director, but he is hardly likely to be the top of anybody's list for hiring anyway.
