ASDA Parking Ticket
I got a Penalty Charge Notice (PCN) from Sefton Council parking wardens who monitor the ASDA car park last week as my parking ticket had flipped over on the dashboard and he couldn't read it.
£50 fine or £25 if payable within 14 days.
Tried an appeal with proof of payment etc which came to nothing.
Parking Services responding that you have to pay and that the ticket must be readable from outside the vehicle at all times and that both elements form the contract entered into by parking. So although I had paid I was still liable for the PCN and the appeal was dismissed.
Such ticket transgressions are apparently known as "flutter" tickets and most Council use their discretion once proof of payment has been received and cancel the PCN - except Sefton who always play hard ball and quote the "ticket must be displayed" bit.
Has anyone had a ticket on ASDA car park and not paid the PCN.
Wondering what the enforcement is if you don't pay it - on principle that I had already paid the parking fee
Magistrates Court, Debt Collection company or written off ?
Anyone know the Councils Parking Policy ?
PS this relates ONLY to Sefton Council issued PCN tickets not Private firm tickets which is legally completely different.

Must be hard to look through your window after closing the door?
Look at it from their point of view. The ticket you have showed them could be from any car near by that had a ticket that was leaving at the same time as you. You ask them for the ticket so you can make out you had one. (not saying this is what happened, but what could be done.)
Learn your lesson, pay your fine and move on. £25 for a lesson in observation.

That could have happened true, but as my credit card number is on the bottom of the ASDA receipt that isn't what actually happened.

Surely it would be easy to have the date and time printed on the reverse, many car park use a sticky label so you adhere the ticket to your windscreen or use the same systems as Sainsbury/Sports Direct pay as you leave.

Sefton Council has been asked many many times to add an adhesive strip to parking tickets, but they continue to refuse the requests, hardly surprising when they accumulate so much revenue from tickets flipping, or slipping off the dashboard.
More dishonest persecution of the motorist.

My missus keeps a small 'floppy' bean bag type of toy in her car precisely for this situation. She simply plops it next to the windscreen and tucks the ticket inbetween facing outwards. Result: No movement due to wind and easy to see from the outside.

If you have genuinely paid (which you obviously have) then yes you have every right to feel aggrieved, however it’s your responsibility to display the ticket so that it’s visible.
If that means wedging it in the corner of the dash / windscreen, using a bean bag (as suggested by Blackrock) or buying a parking permit / ticket holder off eBay for a couple of quid, both my wife and myself have one then so be it.
Most of the “flipped” tickets happen when you close the doors, it only takes a second to check if it’s moved.
Pay the fine and move on I’m afraid, wasting your time appealing to Sefton.

My car has a little plastic clip at the side of the screen to put tickets behind so they cant flip over - you can buy similar on ebay - well worth a couple of quid. Your ticket can't flip over, and you don't have to stick a ticket on your screen in the car parks that have that type of ticket.

Totally agree, however about three years ago, I parked on Houghton Street, bought my ticket and duly placed it in my now defunct tax disc holder. On returning to the car, I encountered one of the parking Gestapo stood by my car. I enquired as to whether there was a problem and he told me that he had almost issued a PCN, because, he didn’t see my ticket. I pointed out to him where the ticket was, and he replied, yes, but I didn’t see it. At this point, I said to him, “so your incompetence almost got me a fine”. He simply grunted and walked away.

The same thing happened to me on the Tulketh St. car park. It was pouring with rain, blowing a gale and my daughter had just come out of hospital after major surgery and as I was rushing to get her a few things either the ticket had blown over or I’d put it upside down. I appealed to no avail, I thought there would have been some understanding but no so I paid the fine but felt aggrieved.

Not sure if it's the philosophy of Sefton Council or the parking Gestapo, but on Central 12 car park any mistake or misdemeanor will earn a ticket no matter the situation, sorry, just pay the fine and be done with it, any appeal will take you into the £50 bracket.

Do those parking tickets show a number on both sides of the ticket - as I believe they do? In which case the ticket was readable. Does the legislation state that the ticket must be on show at all times or that it has to be readable at all times? Did the parking attendant take a photograph of the ticket? Have you kept the ticket and sent the authorities a photo copy of it? You say that you shopped at Asda - did you keep your till receipt to show you received a car parking refund? Cambridge council has recently had to refund numerous drivers fines due to tickets being flipped over.

There has been a lot of complaints over this very same issue - drivers have requested that the authorities provide tickets with a peel off sticky back to ensure that parking tickets can be placed more securely - but the councils refuse to do this, because it is a nice little earner.
There is another issue with regard to the Spar in Birkdale village. The outside area does not belong to the Spar store - it belongs to the council, and drivers are very often fined for parking there. But the council refuse to put notices up because they get quite a bit of money from that site.
Best bet, is to appeal and write a very polite letter stating that the ticket was purchased as shown, that you received the refund from Asda and that the parking ticket must have flipped when you opened the boot to get the bags out or something similar to that. If not, pay up and put a curse on the money!

Not quite correct - if the appeal is made within the 'discount' period then, as I understand it, the discount period is extended to cover the appeal process.
